By accessing or using getpartfound.com (the “Site”) or any GetPartFound application or service, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Site or any GetPartFound service.

These Terms apply to all visitors, users, contributors, and others who access or use the Site. By continuing to use the Site after these Terms have been posted, you accept the Terms as currently written.

GetPartFound is an independent content publication and reference site focused on the identification, sourcing, and fabrication of replacement parts for tractors, small engines, appliances, trucks, and related equipment. The Site includes blog posts, reference content, a glossary, and other informational resources.

All content on the Site, including text, images, graphics, logos, audio, video, data compilations, and software, is the property of GetPartFound or its content contributors and is protected by copyright, trademark, and other intellectual property laws.

You may view, read, and link to GetPartFound content for personal, non-commercial use. Beyond that, you may not reproduce, redistribute, republish, modify, or create derivative works from any GetPartFound content without our prior written permission.

The GetPartFound name, logo, and any associated marks are trademarks of GetPartFound. You may not use them without our prior written permission.

The Site and all content on it are provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, GetPartFound disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.

GetPartFound does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, timeliness, or reliability of any content on the Site.

You acknowledge and agree that any reliance on the Site or its content is at your own risk.

To the fullest extent permitted by applicable law, in no event shall GetPartFound, its operators, contributors, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for lost profits, lost data, business interruption, personal injury, property damage, or any other commercial or personal damages or losses arising out of or in connection with your use of the Site or any content found on it.

GetPartFound’s total cumulative liability to you for any and all claims arising out of or in connection with your use of the Site shall not exceed the greater of (a) the total amount you have paid to GetPartFound in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless GetPartFound, its operators, contributors, affiliates, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Site; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or (d) any claim that your use of the Site caused damage to a third party.

You agree not to do, attempt, or facilitate any of the following:

Automated access: Use any robot, spider, scraper, crawler, or other automated means to access the Site or its content for any purpose without our express prior written permission. This prohibition includes scraping for personal use, commercial use, data aggregation, archiving, indexing, or any other purpose.

AI and machine learning training: Use any GetPartFound content to train, fine-tune, validate, evaluate, or otherwise develop any artificial intelligence, machine learning model, large language model, or similar system, whether for commercial, research, academic, or personal purposes. This prohibition is absolute and applies regardless of whether attribution is provided.

Republication: Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site or its content for any commercial purpose without our prior written permission.

Reverse engineering: Reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying ideas of any software, API, or application provided by GetPartFound.

Interference: Take any action that imposes an unreasonable load on our infrastructure, interferes with the proper functioning of the Site, or attempts to circumvent any security or access control measure.

Misrepresentation: Impersonate GetPartFound or any of its contributors, or misrepresent your affiliation with GetPartFound.

Unlawful use: Use the Site for any unlawful purpose or in any way that violates applicable laws or regulations.

GetPartFound participates in affiliate marketing programs. When you click on affiliate links on the Site and make qualifying purchases, GetPartFound may earn commissions at no additional cost to you. Full details are available in our Affiliate Disclosure, which is incorporated into these Terms by reference.

The Site contains links to third-party websites, services, and products. GetPartFound does not own or control these third parties and is not responsible for their content, accuracy, availability, privacy practices, or terms of use. Your interactions with any third party accessed through the Site are solely between you and that third party.

We provide third-party links because we believe they may be useful to readers. Inclusion of a link does not constitute an endorsement of the third party, its content, or its services.

If you submit content to GetPartFound (including but not limited to repair stories, parts identification questions, photographs, comments, or contact form submissions), you grant GetPartFound a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, edit, publish, and distribute that content in connection with operating the Site and related services.

You represent and warrant that any content you submit is your original work or that you have all necessary rights to submit it, and that submitting it does not violate any third party’s rights.

GetPartFound reserves the right (but has no obligation) to review, edit, or remove any user-submitted content at its sole discretion.

By using the Site, you acknowledge and agree that GetPartFound may collect, analyze, and use data generated by your interaction with the Site, including but not limited to:

Page views, click paths, search queries, time spent on pages, and navigation patterns.

Clicks on affiliate links and any associated conversion data provided by affiliate networks.

Referrer information, device type, browser type, operating system, and approximate geographic location.

Form submissions and contact form content, handled as described in Section 11 and our Privacy Policy.

GetPartFound uses this data to operate and improve the Site and its services, including: analyzing traffic patterns and reader interests; identifying which content, parts, or vendors are most useful to readers; optimizing affiliate placement and conversion; detecting and preventing fraud, abuse, and security threats; and reporting aggregated metrics to advertisers, partners, and the public.

GetPartFound may publish aggregated, anonymized, or de-identified data derived from your usage. Aggregated data does not identify you personally and may be shared publicly, in reporting, in marketing materials, or with third parties without restriction.

All personally identifiable information collected through the Site is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

GetPartFound reserves the right to modify, suspend, or discontinue any part of the Site or its content at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Site.

GetPartFound may revise these Terms at any time. When we do, we will update the Effective Date at the top of this page. Significant changes will be noted on the Site or via a banner notice for a reasonable period after the change.

Your continued use of the Site after revised Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, your only remedy is to stop using the Site.

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of laws principles.

Any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the State of Oregon, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with the Privacy Policy (including the Affiliate Disclosure), constitute the entire agreement between you and GetPartFound regarding your use of the Site and supersede all prior agreements and understandings, whether written or oral.
